Nature of Case: Claim for Social Security Disability Benefits Description: Our client, D.W. is a 40 year old woman who suffers from Chronic Obesity and Diabetes. She has been disabled since January 3, 1996. Progression of the Case: Like many of the Social Security Disability cases handled by the social security disability lawyers of Berry & Associates and National Disability Attorney, our client was denied benefits at the original application and again at the Reconsideration level. As a result, we requested a hearing before an administrative law judge (ALJ). Proving disability required that we show not only that our client could no longer perform past work, but that no competitive work was possible. To do this, we began to prepare the case early on and communicated with the treating physicians regarding the way in which they were documenting our client’s symptoms and impairments and how these would impact job performance and reliability. At the social security disability hearing the administrative law judge focused on the impact of our client’s condition on job performance. Specifically, the judge found that our client was incapable of performing any of her relevant work and was precluded from any sustained work because of her limited mobility. In addition, he took note of the effects of her diabetes. Specifically, that her diabetic neuropathy caused pain at a level and frequency that precluded her form being able to maintain attention and concentration. Result: Our client was found disabled and recovered full back benefits and will receive future disability benefits as well through the Social Security Administration. Our client will also be eligible for Medicare and or Medicaid benefits.
