Who Decides if I Qualify for Social Security Disability Benefits? |

After your application is complete, the Social Security office will review it to see if you meet the basic requirements for disability benefits. They will look at whether you have worked long enough and recently enough, your age and, if you are applying for benefits as a family member, your relationship to the worker. The office then will send your application to the Disability Determination Services (DDS) office in your state.
Disability Determination Services (DDS)
The Disability Determination Services (DDS) will decide whether you are disabled under the Social Security law at the first two stages:
- Application
- Reconsideration.
Remember, DDS turns down most applicants…that doesn’t change the fact that we still win almost 90% of our cases at the hearing!
Office of Disability Adjudication and Review (ODAR)
If disability claim is denied at the Reconsideration level by the DDS the claim is removed from the State Agency and assigned to a Federal Administrative Law Judge. At this stage, Berry and Associates begins preparing you and your case for a hearing. It can take anywhere from 6-30 months to have your hearing, depending on where you live. You can rest assured that Berry and Associates will do all we can to make sure your case is heard as quickly as possible. When your case is scheduled, we will be ready.
