Help with Application Requirements for SSI Disability
Tuesday, 11 August 2009 11:48
Last week a blog was written that discuss application requirements for SSI Disability. As you'll see by reading the SSA's online services, the process to get benefits can be long, often taking months and sometimes even years! Wait times for disability benefits have continued to increase each year for the last few years. Without a well documented application, the chances of a person being awarded disability benefits at the application level are difficult (if you are not awarded benefits, there is an appeal process). If you have questions about application requirements for SSI Disability, the disability lawyers are Berry & Associates can help. We want to hear about your case and we will offer a free case review to help.

Social Security and Nationwide Health Information Network
Monday, 10 August 2009 12:09
Social Security Disability application wait times could be getting faster thanks to the NHIN technology. NHIN, or Nationwide Health Information Network allows the SSA to process requests faster. Mary Mosquera writes in govhealthit.com:
A recent report from the agency’s IG found that as of May, applicants received approval and benefits faster when their medical information was submitted through NHIN compared with all other disability cases. SSA plans to broaden its use of NHIN and to publish a request for proposals later this month to do that. The agency expects to award its first contract in January 2010, the report said. SSA wants to automate more of its disability processes. Each year SSA makes more than 15 million patient-authorized requests for medical information from providers who have treated them. Most of the time to decide disability claims is spent waiting for medical records. It typically takes weeks and months to gather the required information, the agency has said. In February, SSA began requesting and receiving electronic health records from several Virginia-based hospitals associated with MedVirginia, a central Virginia health information exchange. SSA is linked to MedVirginia via the federal CONNECT gateway, a tool that enables agencies to access the NHIN.
Additional technology could present an excellent opportunity to applicants awaiting a decision from the SSA. Currently more than half of those that apply for the SSI Disability application are denied. Worse yet, this denial can come months after the disability application was submitted.

The Social Security Disability Compassionate Allowance Fast Benefits
Saturday, 08 August 2009 11:22
For many people applying for benefits, the Social Security Disability process is a slow on. Being awarded benefits can take months, sometimes even years. If you're applying for benefits on your own you might have learned the hard way that sometimes the most obvious disability applications can be denied if the proper medical evidence is not presented.
Did you know: As of May 2009 about 7,563,000 disabled workers received an average monthly Social Security Disability benefit of $1,062.

The Compassionate Allowances Initiative for Social Security Disability

The SSA has a list of 50 conditions where disability applications are flagged to be decided within days. These conditions (list below) may qualify for a Compassionate Allowance.

Diabetes SSDI Benefits - Judge Denied Claim
Saturday, 30 August 2008 11:01
Suffering from diabetes and all its common complications, it's hard to imagine that your claims for diabetes SSDI benefits could be denied. However, if the state agency is not convinced that your claim warrants benefits payments, it can happen. This, however, isn't the end of the road. Next, your application will go to an Administrative Law Judge.

In the complex world of diabetes SSDI benefits cases, you're coming closer to a final answer. At this point, it's extremely important to bring a social security disability attorney on board to assist you, if you haven't already. If your case is once again denied, you and your attorney will have to consider the evidence you've presented for your diabetes SSDI benefits case, and prepare for the Appeals Council.

After being denied twice by the State agency, then by the Administrative Law Judge, your next step in the process is to file an appeal at the Appeals Council in Virginia. There, the Appeals Council will review the Administrative Law Judge's decision and evidence and proceed in one of two ways.

1. The Appeals Council can send the case back to the Administrative Law Judge for further review. This would result in another trial, at which you and your SSI attorney can present further evidence of your disability.

2. The Appeals Council can accept the Judge's ruling of your diabetes SSDI benefits case. If this happens, the next step is filing a complaint with the U.S. District Council, who will review the Appeals Council's decision.

Working to receive your diabetes SSDI benefits can be very challenging. An expert SSDI lawyer will be able to guide you through the confusing process and make your case as strong as possible.

Complications-Diabetes Social Security Disability
Friday, 29 August 2008 12:25
Diabetics who are fighting for their diabetes social security disability benefits have an uphill battle. If you've filed your application on your own, without legal representation, you've probably begun to realize that you may be in over your head. The confusing and time consuming process of filing an original diabetes social security disability claim is only compounded when it's time to follow an appeal and then subsequent appeals. The process can often drag on over a significant time period, as your symptoms continue.

Bringing an attorney who specializes in diabetes social security disability cases onto your team is one of the best things you'll be able to do to help yourself win. With years of experience and many disability cases in their repertoire, the attorney will be able to provide you with advice and guidance as to how best present your diabetes social security disability case.

If any of your symptoms have changed since you first began your application, that will be very important to your case. Diabetics have a tendency to develop complications, such as heart disease, high blood pressure, and periodontal disease. Kidney disease is another common diabetes complication, and can lead to chronic dialysis or the need for a kidney transplant. Nervous system disease might cause pain or lack of feeling in hands or feet, and can lead to amputations. Older diabetics are often unable to walk as little as one quarter mile or climb stairs- symptoms that could certainly effect a diabetes social security disability case.

To help your attorney prepare your appeals, track your symptoms carefully. Be very detailed- if you experience shortness of breath after walking, make a note of how far you walked. Write down specific notes about when you experience impaired sensation or pain in your hands and feet. If your doctor diagnoses you with high blood pressure or hypertension, make a note of it. All these details will help build your diabetes social security disability case.
