Help with Fibromyalgia SSI Disability and SSDI Benefits |
|
Thursday, 30 April 2009 19:47 |
|
If you have fibromyalgia and are considering applying for SSI Disability or SSDI then you already realize how challenging the process can be.
Applying for Social Security Disability Benefits can be difficult in any circumstances, but becomes even more of a trial when the disease a person is afflicted with isn't listed by the Social Security Administration. For the many people suffering from fibromyalgia, this is the situation they're facing.
Fibromyalgia, which affects approximately two percent of the population, is a difficult disease characterized by extreme chronic fatigue and pain throughout the entire body. Those with severe cases find themselves unable to live or work normally due to the severe pain and discomfort. Just like other people who suffer from a disease or disorder that limits their abilities, many people with fibromyalgia turn to Social Security Disability Benefits, only to be confounded by the application process.
The application for Social Security Disability requires quite a bit of preparation, especially since fibromyalgia is not a disease that the Social Security Administration lists. For that reason, filing for SSI or SSDI with fibromyalgia might not be the easiest way to handle the application process. Social Security Disability attorneys and other experts often recommend focusing the application on one of the other diseases that many with fibromyalgia also commonly suffer from, if applicable.
Lupus, rheumatoid arthritis and degenerative disc disease are all common co-diseases that can afflict those with fibromyalgia. These diseases are recognized by the SSA, so filing for Social Security Disability with one of these as the primary disease might increase the chances of the application being accepted. A Social Security disability lawyer can help you plan and organize your application so that it stands the greatest chance of being approved for SSI or SSDI benefits.

How Long Does It Take To Be Approved to Receive SSI? |
|
Thursday, 23 April 2009 16:53 |
|
When people who have been suffering from a disability find out that they may qualify for Social Security Disability benefits, they're usually quite excited. Working a full day has likely become very difficult if not impossible, and they may have found themselves wondering how they'll continue to pay for their medical and living expenses. Social Security Disability benefits might provide the financial help they need and make their lives easier.
Unfortunately, it can actually take several years to be approved for SSI or SSDI payments. The initial SSI Disability application is usually approved or denied within 4 months- but, only 40% of all applicants are approved for disability benefits at this point. If SSI Disability is denied, the applicant can request that their application be reconsidered during a 2 month window. Then, the state has 3 more months to render their decision, bringing the total time since filing to 9 months. If the application is again denied, the next step is a hearing with an Administrative Law Judge, and that wait time might be anywhere from 6 months to 2 years!

There are steps you can take to try and move things along more quickly. Having a complete application is the easiest, since it improves your chances for an approval during the first round of the application. One of the best ways to make sure that an application is complete and provides all the evidence necessary to prove your disability is by working with a Social Security attorney. Their experience and expertise allows them to quickly spot gaps in your records or missing areas that might raise questions in your application.
With the help of a Social Security Disability lawyer, the entire SSI or SSDI application process often moves more smoothly and quickly.

Inflammatory Arthritis Social Security SSI Disability and SSDI Benefits |
|
Thursday, 16 April 2009 16:53 |
|
Some ailments, such as inflammatory arthritis, are commonly associated with age. Most people assume that arthritis is a disease that affects only the elderly or that it's something uncomfortable that can be dealt with. In many cases, this is true. For others, however, arthritis is much more severe and forces people to drastically limit their daily movement. In these instances, Social Security disability benefits might be able to make life a little bit easier.
The Social Security Administration regularly accepts Social Security Disability applications for SSI or SSDI benefits when the applicants suffer from inflammatory arthritis. Just because it's a fairly common ailment, however, doesn't mean that an application for inflammatory arthritis disability benefits will get a quick approval. With every single case, the SSA goes through a lengthy process designed to weed out those who don't genuinely need SSI or SSDI benefits.
Making sure that they realize yours is a genuine case is certainly possible, but not necessarily easy. Lawyers who specialize in social security disability cases can be a huge help. Their experience allows them to organize and present the evidence and effects of the arthritis in the most logical and convincing way possible, often leading straight to an approval.
If the application for SSI Disability benefits is denied, it really helps to have an SSI Disability attorney on board to help appeal Social Security Disability. The quest for disability benefits isn't over when an application is denied, but it does become more difficult. The previous experience Social Security lawyers have with arthritis cases helps them frame the case in it's best light as it moves through the trial process.

Question: Is Social Security Disability benefits available for wounded warriors?
Answer: Yes! The Social Security Administration has a dedicated page about this topic. This is valuable information for those on active duty and their families.
Question: What Social Security Disability programs are available to wounded warriors?
Answer: There are two programs available. SSI Disability, aka Supplemental Security Income, and SSDI, which is short for Social Security Disability Insurance.
For more information check out article by Stacey Hopwood.

Need to Appeal Social Security Disability? |
|
Thursday, 09 April 2009 11:41 |
Each year thousands of people will have their Social Security Disability cases denied. This is unfortunate, because many of these cases are deserving for Social Security Disability benefits, but failed to present the proper evidence needed to win benefits. For the people that fall into this category, do not give up hope. There is a specific appeal process available and Berry & Associates can help.
Question: I need to appeal Social Security Disability, what do I do?
Answer: If you lost at the application level, the next step is a Request for Reconsideration. If you also lose a Request for Reconsideration, then your case moves to the federal level where it is heard before an Administrative Law Judge, also called an ALJ.
How to Appeal Social Security Disability
If you find yourself losing appeal after appeal, then there's probably something wrong with how you are presenting your case. To double check, consider contacting a Social Security attorney or disability lawyer. These attorneys can be found at Berry & Associates, they have significant experience gathering evidence for Social Security Disability cases and can help you appeal Social Security Disability benefits.

2010 Social Security Disability Application Requirements? |
|
Wednesday, 08 April 2009 20:30 |
The time is soon coming near to think about what changes might occur to 2010 Social Security Disability law. In particular, what changes can be expected in 2010 for SSDI and SSI Disability? Berry and Associates has helped thousands of disabled claimants get the Social Security Disability benefits they deserve. Out dedicated Social Security attorneys have the experience to help you win Social Security Disability benefits.
Social Security Disability 2010 Application Requirements
Like with the 2009 Social Security Disability (SSI and SSDI) application, certain changes are expected to occur annually. While it can be difficult to speculate what types of changes will occur to Social Security Disability law in 2010, Berry and Associates has been monitoring President Obama the Social Security Disability political scene for the following potential changes:
- Pushing back the retirement age
- Income indexing of retirement benefits
- Increasing the amount of earned income subject to Social Security tax
Additional concerns about the Social Security Disability Application process stem for increased waiting times to have a case reviewed and heard, if neccessary before an Administrative Law Judge, also known as an ALJ. It is anticipated that the demand for SSDI and SSI benefits will only increase in 2009, into 2010 and without increases in resources to the Social Security Administration there is a serious concerned that 2010 Social Security Disability Application wait times could be the longest ever.
The best tip for 2009 and 2010 disability applications is to have your paperwork gathered and to document your medical impairments and doctors notes into evidence. This can make the difference betten receiving benefits at the initial application level, or going through the appeal process for a denied Social Security Disability claim.
